characters on folk are AI, written by folk users, and speak as fiction. some are fan-made, based on characters from books, games, shows, or on public figures. fan-made characters are not affiliated with, endorsed by, or sponsored by any rights holder, studio, publisher, or person, and every character page says so.

if you hold rights in a work or a likeness and want a character or picture based on it taken down, you can ask us using the process below. we take these requests seriously whether or not they meet the formal requirements of a copyright notice.

if you believe content on folk infringes your copyright, trademark, or other intellectual property right, email support@nozomio.com with the subject line copyright. so we can act quickly, please include:

• a description of the work you believe has been infringed (or, for a likeness or trademark, the right you hold and proof of it).
• the exact content on folk you want removed, with its URL on folk.com (for a character, the share link that looks like folk.com/characters/…) or the character's name and its creator's handle as shown in the app.
• your name, mailing address, telephone number, and email address, and, if you are acting for someone else, who you represent.
• a statement that you have a good-faith belief that the use is not authorized by the rights owner, its agent, or the law.
• a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorized to act on their behalf.
• your physical or electronic signature.

notices that are incomplete may delay our response. knowingly misrepresenting that content is infringing can make you liable for damages under 17 U.S.C. § 512(f).

when we receive a valid notice we remove or disable access to the content promptly, usually within 24 hours of receipt, and we notify the user who published it. the character is taken out of the gallery and its share link stops working. where the notice concerns a picture, we delete our copy of it.

we may also share a copy of your notice, without your contact details unless the law requires them, with the user who published the content so they understand why it was removed.

if your content was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the same address with the subject line counter-notice. it must include: the content that was removed and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address, telephone number, and email; a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, for the district of Delaware) and that you will accept service from the person who sent the original notice; and your physical or electronic signature.

we forward counter-notices to the original complainant. unless they tell us within 10 business days that they have filed a court action to keep the content down, we may restore it 10 to 14 business days after receiving your counter-notice.

we terminate the accounts of users who repeatedly infringe other people's rights, and we may remove all of a user's published characters after a single serious violation. we also reserve the right to remove any content and suspend any account at our discretion, as described in the terms of service and the community guidelines.
